TERMS AND CONDITIONS OF BOOKING FOR FOXHOLES FARM COTTAGES  

PLEASE READ THESE CONDITIONS CAREFULLY, WHEN YOU MAKE A RESERVATION YOU ARE ENTERING INTO A LEGALLY BINDING CONTRACT THE TERMS OF WHICH ARE SET OUT IN THESE CONDITIONS.

1.Foxholes Farm Cottages

1.1.The contract for a Short Term Holiday Rental Period will be between Martin Hartley Hague and Jean Angela Hague trading as Foxholes Farm Cottages (referred to as "us" or "we" ) and the person making the booking and all members of the holiday party (referred to as "you" or "your") in the following booking conditions.

1.2.The contract for a Short Term Holiday Rental Period is not effective until we have received the deposit that is due at the time of making your booking (“the Deposit”). The contract will be subject to these booking conditions at all times thereafter.

1.3.Before booking, please read these booking conditions carefully and all the other information relevant to your booking,  

1.4.You agree that your booking for the Short Term Holiday Rental Period is for the sole purpose of holiday accommodation and accept that you are not offered any rights to the property other than the right to occupy the property as holiday accommodation for the period of your booking. No booking of any kind is an ‘Assured Shorthold Tenancy’ or protected under the Protection from Eviction Act 1977,  

1.5.You, as the person in charge of the party (“the party leader”), must be at least 18 years old at the time of booking.  All other members of the party must authorise you to make the booking on the basis of these booking conditions. By making the booking, you confirm that you are authorised to make the booking and that all other members of the party agree that the booking will be governed by these booking conditions. You, as the party leader, are responsible for making all payments due to us.  

 

2.Payment and Booking

2.1.When you book, you must pay the Deposit which amounts to 50% of the total cost of your stay with us.  The remainder of the balance is payable 7 days before the start of your Short Term Holiday Rental Period begins.  

2.2.All payments must be made by debit or credit card or by cheque or direct bank transfer.  

2.3.If a booking is made less than 7 days before the start of the planned Short Term Holiday Rental Period the full rental charges at the time of booking are payable.    

2.4.If you do not pay any payment due in relation to your booking by the appropriate date, we are entitled to assume that you want to cancel your booking. In this case, your booking will be cancelled immediately.  You are therefore fully aware that late payment could result in your Short Term Holiday Rental Period being cancelled. In this event any payments already made will not be refunded and you will remain liable for the outstanding balance if we are unable to secure an alternative reservation for the period.

2.5.The Deposit is non-refundable.

2.6.Any payment made in accordance with clause 2.3 is non refundable.

2.7.If cancellation is made after the date that the balance of the booking has been made in accordance with clause 2.1 (i.e. the whole Short Term Holiday Rental Period has been paid) then the whole amount paid will be retained unless the cottage that is the subject matter of your booking can be re-let. If a re-let is successful then a refund (less the Deposit) will be made, less an administration fee of £25.00.  If the cottage that is the subject matter of your Booking cannot be re-let then no refund will be given.

 

3 Pricing  

3.1.The quoted price and the price paid for the full period of the Short Term Holiday Rental Period are accommodation prices are for the cottage that is the subject matter of the booking as a whole and are not on a price per person basis.

3.2.The price paid includes, subject to these terms and conditions, the use of a laundry room, free Wi-Fi, linen, duvets and towels, electricity, outdoor storage for bikes and prams, the use of an iron, ironing board and washing facilities, car parking, high chairs and cots (subject to availability and prior advance notice of at least 3 days having being received)

3.3. Occasionally, problems mean that some facilities or services are not available or may be restricted. If this happens, we will tell you as soon as reasonably practical after we become aware of the situation. We cannot accept responsibility for any changes or closures to local services or attractions mentioned on our website. We make reasonable efforts to make sure that information we give you about your cottage and its facilities or services, as well as advertised travel and other services, is accurate and complete on the date given. We cannot accept responsibility for any inaccurate, incomplete or misleading information about any cottage or its facilities and services, unless this was caused by our negligence.

3.4.In relation the Wi-Fi, please note that its provision is subject to availability and network conditions.   Bookings are not accepted if they are wholly reliant on the uninterrupted, unlimited provision of Wi-Fi.

 

4 Cancellations or changes by Us

4.1.We do not expect to have to make any changes to your booking. However, sometimes problems happen and bookings have to be changed or cancelled or mistakes or other details corrected.  We have the right to do so. If we do, we will contact you (by phone if reasonably possible in the case of a significant change or cancellation – we will let you know about minor changes by email) as soon as is reasonably practical. We will explain what has happened and let you know about the cancellation or change. However, we will have no further liability to you.

4.2. We will not be legally responsible either jointly or individually for any compensation if we are prevented from carrying out our responsibilities under this contract as a result of events beyond our control. This means an event we or they could not, even with all due care, avoid, including:

4.2.1.strike, lock-out or labour dispute;

4.2.2.natural disaster;

4.2.3.acts of terrorism, war, riot or civil commotion;

4.2.4.malicious damage;

4.2.5.keeping to any law or governmental order, rule, regulation or direction;  

4.2.6.accident;

4.2.7.breakdown of equipment or machinery;

4.2.8.fire, flood, snow or storm;

4.2.9.other circumstances affecting the supply of the arrangements.

 

5 Disabilities and medical problems

5.1.If you or any member of your party has any medical problem or disability that may affect your booking, please tell us before you confirm your booking and give us full details in writing as early as possible before you travel. If we reasonably feel unable to properly meet that person’s particular needs, we can refuse or cancel the Booking.

 

6Your Cottage

6.1.Arrival and departure: You can arrive at your Cottage at any time after 2.00 pm (unless we tell you otherwise, for example on your confirmation) on the start date of your Short Term Holiday Rental Period. You must leave by 10.00 am on the last day of your Short Term Holiday Rental Period.

6.2.The keys to your Cottage will be located in a secure safe located within the cottage complex.  You will be provided with the access code to your particular cottage prior to the commencement of your Short Term Holiday Rental Period.

6.3. If you fail to arrive by 12 noon on the day after the start date of your Short Term Holiday Rental Period and you do not let us know that you are arriving late, we may elect to treat your booking as having been cancelled by you. In this situation, we will not refund any money you have paid.  

6.4.You and all members of your party agree:

6.4.1.to keep the Cottage clean and tidy;

6.4.2.to leave the Cottage in a similar condition as you found it when you arrived;

6.4.3.to behave in a way at all times while at the Cottage which does not break any law;

6.4.4.not to use the Cottage for any illegal or commercial purpose;

6.4.5.not to sublet the Cottage or any part thereof or otherwise allow anyone to stay in it who we have not previously accepted as a member of your party;

6.4.6.not to behave in anti-social manner, breach the peace or otherwise act in a way which may disrupt or affect the enjoyment of others.

6.4.7.not allow more people than the Website states may be accommodated in the Cottage.

6.4.8.To put all debris and rubbish in the rubbish bins provided.

6.4.9.Leave all keys to the Cottage in the safe provided.

6.4.10.To lock the doors and close the windows when You leave your Cottage unoccupied.

6.5.In the event that any keys issued are not returned at the end of your Short Term Holiday Rental Period then the cost of replacement will be charged to you.

6.6.Children under 18 must be supervised by their parents/guardians at all times.

6.7.Pets are not allowed to stay in the Cottages.

6.8. The Cottages are no smoking, including E-cigarettes.  We fully reserve the right to recover from You any costs associated with cleaning the Cottage in the event that in our opinion, acting reasonably, there has been smoking in or near to the Cottage.  

6.9.Where parking spaces are used these are only suitable for standard sized saloon vehicles, reasonable sized MPV’s or 4×4’s. Parking is entirely at the vehicle owner’s risk.  

6.10.Where you or your party use the buggy and pram park facilities or the laundry facilities provided you do so at your own risk and we shall have no liability for any loss or damage suffered to any items or belongings that are damaged or stolen as a result.

 

7 Damage

7.1.You are responsible for and agree to reimburse us all costs incurred by us a result of any breakage or damage in or to the Cottage or the Foxholes Farm complex which is caused by you or any members of your party or any other persons invited into the Cottage by you.

7.2.We expect the Cottage to be left in a reasonable state on departure.

7.3.If in our or our caretaker’s opinion, acting reasonably, additional cleaning is required, you will be liable to us for the cost of this cleaning.  

7.4.If you discover that anything is missing or damaged on arrival please notify us immediately as provided for below at clause 10.  

 

8 Right of Entry

8.1.We must fully reserve the right to enter the Cottage (without letting you know first if this is not practical or possible) if special circumstances or emergencies happen (for example if repairs need to be carried out) or if you break any of these booking conditions.

8.2.Our representative is allowed to enter the Cottage to inspect it (including but not limited to where you have complained about the Cottage). If this happens, you will be given reasonable notice first. You agree to allow Us or Our representative (including workmen) access to the Cottage as required by this clause.

 

9 Unreasonable behaviour

9.1.We reserve the right to refuse to allow you access to the keys to the Cottage if the unreasonable behaviour of anyone in your party is likely to cause offence to other guests or to neighbours, or if we have reasonable cause to believe you or any member of your party will cause damage or loss to the Cottage, its services or facilities.

9.2.If this happens, the contract between you and us will end immediately and you will not receive any refund and neither we nor will we have any further responsibility to you.

9.3.We reserve the right to end your Short Term Holiday Rental Period after the keys have been accessed, if the unreasonable behaviour of anyone in your party (including anyone invited into the property by you) is likely to spoil the enjoyment, comfort or health of other guests, neighbours where you or any member of your party (or anyone invited into the Cottage by you) has broken or is likely to break any of these booking conditions.  If this happens, you will have to leave the Cottage immediately and no refund will be given. You may also be responsible for any costs that we have as a result of your behaviour as set out in this clause.  

 

10 Issues on Arrival

10.1.If on arrival at the Cottage you do not consider that it complies with the advertised description, or if you consider that it is not fit for your occupation for any reason, you must advise us immediately by calling 07917 030602 in order that an appropriate investigation can be made. We will not consider any claim or complaint arising from alleged defect or misdescription of the Cottage unless notice is lodged in this manner within 24 hours of arrival at the Cottage.

10.2.Any issues or problems that may arise with the Cottage during your Short Term Holiday Rental Period must be immediately reported to us on 07917 030602. This is the quickest way of resolving any problems that might occur.  Under no circumstances will we entertain any claims for issues or problems that were not reported within 24 hours of arrival or as soon as they occurred.

 

11 Liability

11.1.In all cases, except personal injury or death, our liability to you for the total of all claims arising out of your Short Term Holiday Rental Period is limited to the cost of your booking less any insurance, cancellation, amendment or separate charges. We will not be responsible for any matters that result from any unforeseeable events that are beyond our control.

 

12 Governing law and jurisdiction

12.1.Any dispute, claim or other matter which may arise in relation to your booking will be governed by English law and you agree that any dispute will be dealt with exclusively by the courts of England and Wales.
